These terms apply when you purchase a website design and build service from Sightly Web Design via sightlydesign.com. By paying for the Service, you agree to these terms.
1. The Service
Sightly provides a fixed-price website design and build service (currently €299.99), including:
- A custom design matched to your business
- A fully built and launched website
- Mobile, tablet, and desktop compatibility
- Basic on-page SEO foundations (page titles, structure)
- Post-launch support from Sightly
2. Process
- You purchase the Service via our secure payment page (processed by Stripe), or agree to proceed after a consultation call.
- We contact you within one working day to gather your content, branding, and requirements.
- We design and build your site, incorporating your feedback.
- We launch the finished website and remain available for support afterward.
3. Payment
Full payment (€299.99, unless otherwise agreed in writing) is due upfront to begin work. Payments are processed securely by Stripe; Sightly does not store your card details.
4. Your responsibilities
To deliver your website on schedule, we rely on you to:
- Provide content (text, images, logos) and feedback in a timely manner
- Ensure you have the right to use any content, images, or trademarks you supply to us
- Respond to requests for approval or information during the build process
Delays in providing content or feedback may delay your launch date.
5. Refund Policy
We want you to be happy with your website. Our refund policy is:
- Within 30 days of purchase: You may request a full refund, for any reason, by contacting us at sightly.webdesign@gmail.com or 083 349 1240.
- After 30 days of purchase: Refunds are not available.
Your statutory right to cancel: Separately from the above, if you are a consumer purchasing this Service online, Irish and EU law gives you a statutory right to cancel a distance contract within 14 days of purchase without giving a reason (the "cooling-off period"), under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013. Our 30-day refund window is more generous than this legal minimum and does not remove or reduce your statutory rights.
If we have already begun substantial work on your website at your request before a refund is requested, we reserve the right to deduct a reasonable amount reflecting work completed, in line with applicable consumer protection law — we will always discuss this with you first.
6. Intellectual property
Ownership of the design, code, and files that make up your website ("the Website") remains with Sightly at all times and is not transferred to you, unless we agree otherwise with you in writing. Instead, you are granted a licence to use the Website for its intended purpose (i.e. as your live business website), for as long as your account with us remains active and in good standing.
Sightly retains this ownership so that we can:
- Carry out further edits or updates to the Website on your behalf
- Maintain and host the Website
- Take the Website offline if ongoing maintenance, hosting, or other agreed fees remain unpaid, after reasonable notice to you
If your account falls into arrears, we will make reasonable efforts to contact you and give you an opportunity to bring payments up to date before taking the Website offline.
Content you supply to us — such as your business's own text, photos, logo, and branding — remains your property. Any third-party assets (stock images, fonts, plugins) remain subject to their own licence terms.
If you wish to obtain ownership of the Website files (for example, to move to another provider), this can be arranged separately and may be subject to an additional fee — contact us to discuss.
7. Post-launch support
Support and minor updates after launch are provided as described at the time of purchase or as separately agreed. Significant additional work outside the original scope may be quoted separately.
8. Limitation of liability
Sightly will perform the Service with reasonable skill and care. To the extent permitted by law, Sightly's liability for any claim arising from the Service is limited to the amount paid for the Service. We are not liable for indirect or consequential losses (e.g. loss of business, loss of profits).
Nothing in these terms limits your statutory rights as a consumer under Irish law.
9. Governing law
These terms are governed by the laws of Ireland, and any disputes will be subject to the exclusive jurisdiction of the Irish courts.
10. Changes to these terms
We may update these terms from time to time. The version in force at the time of your purchase applies to that purchase.
